... Taiwanese citations are now also available in English?

On 1 July 2010, the Taiwan Patent Office (TIPO) launched a new English interface of the TWPAT database, where users can now also see citations. Citation data is available for patent applications published after 1 January 2008. (Previously, this information could only be accessed in Chinese.) Furthermore, in addition to PDF versions of original documents, corresponding information as published in the gazette has now become available for both laid-open and granted publications.

... China and Chinese Taipei have agreed to recognise each other's priority rights?

On 29 June 2010, an agreement on intellectual property protection was signed between Mainland China and Chinese Taipei in Chongqing, China, together with an "Economic Cooperation Framework Agreement" (ECFA). Under the IPR protection agreement, both sides have agreed to recognise the priority claims of applicants from the other side during a period of one year for patents and six months for trade marks. Previously, this was not possible. Other items in the agreement include the protection of plant varieties, co-operation in search and examination, and co-ordination of measures against infringement and counterfeiting.

... TIPO has published an English version of its "Accelerated Examination Programme"?

As mentioned in earlier news items, the Taiwan Patent Office (TIPO) has its own set of procedures, based on the Patent Prosecution Highway, to accelerate the speed of patent examination. After a one-year trial period, amendments to the accelerated procedure entered into force in January 2010.

... a Taiwan Patent Attorneys Association has been established?

The "Taiwan Patent Attorneys Association" (TWPAA) was formally established on 11 December 2009 under the "Patent Attorney Act". The TWPAA website can be accessed at http://www.twpaa.org.tw/ (currently Chinese only).

... TIPO has amended its official forms for patent-related matters?

These official forms, in Chinese only, relate to various patent matters (e.g. patent/utility model application, request for substantive examination, filing of divisional applications, filing of amendments, etc.) and are all available as Word documents on the Taiwan Patent Office (TIPO) website. The old versions of the forms may still be used until 31 December 2010.

... amendments to the Taiwan Patent Act are officially on the way?

The proposed changes will include animals and plants as patentable subject-matter, new regulations relating to public health issues, and amended time limits and grace periods.

A further aim is to strengthen both patent examination and patent protection procedures. The draft proposals were reviewed by the executive branch of the government ("Executive Yuan") in December 2009 and the legislative process has started.

... the Taiwan Patent Office (TIPO) has reduced its renewal fees?

TIPO's new patent fee schedule in force since 1 January 2010 includes reduced renewal fees for patents, utility models and designs. Furthermore, new provisions apply to the calculation of examination fees and to the refund of fees if an application is withdrawn.

... amendments to TIPO's accelerated examination procedure have entered into force?

The Taiwan Patent Office (TIPO) has its own set of procedures based on the Patent Prosecution Highway (PPH) system to accelerate the speed of patent examination. Although Taiwan is currently not part of any PPH agreements with other patent offices, applicants can now submit documents relating to applications recently published or soon to be published in other countries to TIPO in order to help speed up the examination procedure. Following a one-year trial period, TIPO has now introduced a number of amendments to its accelerated procedure. These amendments entered into force on 1 January 2010.

... TIPO's English database now uses a standardised system for the Westernisation of Chinese names?

Starting with patent applications published after 16 July 2009 and utility models registered after 11 June 2009, the names of applicants and inventors are shown in TIPO's English database using the standardised Hanyu Pinyin format, which is also the standard in Mainland China. ... TIPO's TWPAT database now also contains citations?

The Taiwan Patent Office (TIPO) has enhanced the functionalities of its free TWPAT database. Backward and forward citations are now available on the Chinese search interface for patents and utility models published after 1 January 2008. In addition, new search fields have been added and the options for display of the results have been extended.

... Taiwan has amended its patent term extension provisions?

In April 2009, the Taiwan Patent Office (TIPO) announced the amendment of chapter 8 of the "Guidelines for Substantive Examination of Invention Patents", which concerns the extension of patent terms. The revisions include the definition of which patents can be subject to term extension; how pharmaceuticals and agrochemicals are defined; the scope of the right during extension; clarifications on the determination of dates and other criteria.

... TIPO has launched mechanisms for accelerating the patent examination procedure?

On 1 January 2009, the Taiwan Patent Office (TIPO) launched its own set of procedures based on the "Patent Prosecution Highway" (PPH) system to accelerate the speed of patent examination. Although Taiwan is currently not part of any PPH agreements with other patent offices, patent applicants can now submit documents relating to applications recently published or soon to be published in other countries to TIPO in order to help speed up the examination procedure. This accelerated examination mechanism will run for a trial period of one year and will then be reviewed.

... TIPO has launched its e-filing system "TIPONET"?

On 26 August 2008, the Taiwan Patent Office (TIPO) launched an e-filing system for patents and trade marks, which can be accessed at the following URL: http://tiponet.tipo.gov.tw/home/. In order to encourage applicants to use online instead of paper filing, the application fee has been reduced by approximately EUR 13 per document for patents and EUR 6.5 for trade marks. By using the online filing system, applicants can save about 16 % of the application fee for patents and up to 10% for trade mark applications. For the time being, applications can only be submitted during TIPO's service hours (Monday to Friday between 8.00 and 17.00 hrs). However, TIPO is planning to implement a 24/7 service in the near future.

... Chinese Taipei (TW) inaugurated its first Intellectual Property Court on 1 July 2008?

In order to improve the settlement of disputes related to intellectual property, TW has established a special IP court which will handle civil, criminal and administrative cases. The court will hear cases related to all types of intellectual property rights. In addition to their legal background, the judges of the court will have knowledge in different technical fields. Patent examiners from the Taiwan Patent Office (TIPO) will provide further technical expertise to the court. ... the Taiwanese Patent Office (TIPO) has relaunched its free English patent search system TWPAT?

From 1 July 2008 onwards, original documents of Taiwanese patents, utility models and designs will be available in PDF format via an English search interface at http://twpat.tipo.gov.tw/tipotwoc/tipotwekm

In addition, the source has been equipped with new interfaces which can be searched by numbers, dates, IPC classes and keywords to retrieve English abstracts for patents and bibliographic information for utility models and designs. Basic legal status information for Taiwanese documents is now also available in English via this source.
